Emerging Trends and Innovations in Dispute Resolution
Dispute resolution has gained renewed attention since the COVID-19 pandemic started. This event will see our panel of experts examining the trends and advancements in dispute resolution that took place in 2022 and anticipate what is yet to come. The panelists will also highlight the important changes in the recently updated ICDR Arbitration and Mediation Rules, with a specific emphasis on mediation. The panel will highlight the importance of staying up-to-date with the latest developments in dispute resolution and the role that education and training can play in promoting the growth of the field.

The speakers will discuss the benefits of the online case management system and its role in promoting more environmentally friendly arbitrations. The panel will address the challenges associated with the use of technology in dispute resolution, including issues of cybersecurity, data privacy, and fairness and will explore the measures to overcome these challenges.

Finally, the panel will discuss how COVID-19 has accelerated the adoption of online dispute resolution and the need for more flexible and accessible dispute resolution mechanisms like the hybrid hearing system which is being embraced by arbitral institutions.

Michael Peer

Michael is partner with Control Risks, a specialist risk consultancy, responsible for the Forensic and Technology practice in Asia Pacific. He is an accountant who also studied both valuation techniques and arbitration law, meaning he brings a different perspective to the complex problems clients ask him to assist in resolving. Michael has had the privilege of working in many regions over the course of his career. First in North America, then Europe, the Caribbean, Central and Eastern Europe and now Asia, which helps him understand the cultural nuances at play in disputes. Michael’s practice focuses on establishing facts so that the parties to a dispute can base their negotiations on an agreed fact pattern, advising clients on possible financial outcomes of a dispute, sometimes as a jointly appointed expert, as well as assisting both judges and arbitrators to understand the accounting and valuation issues put before them for resolution, either as an expert witness or a tribunal member.

Z.J. Jennifer Lim is Partner at Sidley Austin LLP in Singapore. She focuses her practice on international dispute resolution and arbitration, representing clients in investor-state and commercial arbitrations, including proceedings conducted under the ICSID, ICSID (Additional Facility), and UNCITRAL Rules, as well as ICC, HKIAC, SIAC and LCIA arbitrations seated in Hong Kong, Singapore, Spain, Washington DC and New York. Jennifer also sits as arbitrator and has broad experience advising on general transnational litigation matters, including arbitration-related court proceedings and complex cross-border disputes. Jennifer is an active member of the YSIAC Committee, where she is contributing to a report on resolving ESG disputes through international arbitration. Michael Lee directs the International Centre for Dispute Resolution (ICDR)® Asia Office in Singapore. Mr. Lee recruits and maintains the highest qualified panel in Asia for the ICDR’s International Panel of Arbitrators and Mediators. He is responsible for the ICDR’s Asia regional operations, including arbitration and mediation in the rapidly expanding Singapore arbitral seat, providing executive oversight of large cases. Michael is a frequent speaker to corporate and outside counsel on the importance of using arbitration and mediation to solve cross-border disputes, augmenting with research data on dispute management and business negotiation and clarifying the AAA-ICDR’s comprehensive rules and administrative process. He has been serving as the Chair of Legal Committee for AMCHAM (American Chamber of Commerce) Singapore since 2009.
